One Big Media Company (OBMC)
These Terms of Service (“Terms”) govern your use of the products, services, websites, applications, and AI-powered tools (“Services”) provided by One Big Media Company (“OBMC,” “we,” “our,” or “us”). By accessing or using our Services, you agree to these Terms. If you do not agree, you may not use our Services.
1. Services Provided
OBMC offers a range of media, publishing, digital tools, and artificial intelligence–powered agent services (“AI Agents”). Some services are free, while others require payment. Certain features, including but not limited to AI Agents, may be subject to separate billing as described in Section 5.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use our Services. By using our Services, you represent that you meet these requirements.
3. User Responsibilities
You are responsible for any content you submit, create, or interact with while using our Services. You may not use our Services for unlawful, harmful, fraudulent, or misleading purposes. You must comply with all applicable laws and regulations while using our Services, including intellectual property and privacy laws.
4. AI Agent Services
OBMC provides access to AI-powered agents designed to assist with media, content, and business workflows. Important Notices: AI Agents generate content algorithmically and may produce inaccurate, incomplete, or unintended outputs. You should not rely solely on AI-generated content for legal, financial, medical, or safety-critical decisions. OBMC makes no warranties regarding the accuracy, reliability, or suitability of AI outputs. You remain solely responsible for reviewing and verifying any AI-generated content before use or publication.
5. Fees and Billing
Separate Billing for AI Agents: Usage of OBMC’s AI Agent Services is billed independently from other OBMC services. Fees may be calculated based on usage volume, subscription tier, or other billing models communicated to you at the time of purchase. Payments must be made in accordance with the billing terms provided. Failure to pay may result in suspension or termination of your access. Taxes, duties, and other government charges may apply and are your responsibility.
6. Intellectual Property
All rights, titles, and interests in OBMC’s Services, including AI models, tools, and content, remain the property of OBMC or its licensors. You retain ownership of any original content you upload or create but grant OBMC a non-exclusive, worldwide license to host, process, and display such content for the purpose of providing the Services.
7. Disclaimers
Services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied. OBMC disclaims all warranties including merchantability, fitness for a particular purpose, and non-infringement. AI Agents may produce outputs that are offensive, biased, or otherwise undesirable. OBMC does not endorse or assume responsibility for such outputs.
8. Limitation of Liability
To the maximum extent permitted by law: OBMC shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or goodwill. OBMC’s total liability for any claim relating to the Services shall not exceed the greater of: (a) the amount you paid to OBMC for the Services in the 3 months preceding the claim, or (b) $100 USD.
9. Indemnification
You agree to indemnify, defend, and hold harmless OBMC and its affiliates, officers, employees, and partners from any claims, damages, or expenses arising out of your use of the Services, your content, or your violation of these Terms.
10. Termination
We may suspend or terminate your access to the Services at any time, with or without cause or notice. You may discontinue use of the Services at any time.
11. Changes to These Terms
OBMC may update these Terms periodically. We will post the updated version with a new “Effective Date.” Your continued use of the Services after updates constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by and construed under the laws of the jurisdiction in which OBMC is incorporated, without regard to conflict of law principles.
